Foreclosure by judicial sale and the other one is Foreclosure by power of sale. The former is also known as judicial foreclosure. This kind of foreclosure is usually available in every state and in this case the mortgage is supervised by a court. The preference given by the court in the event of a foreclosure is such that the mortgage is satisfied first and then the mortgage holder and at last the borrower or the mortgagor who has borrowed money on their property. The foreclosures are filled in federal courts but they are done rarely and they are done in the wake of preventing any mal practice. Any foreclosure sought by the mortgagee should be legally informed to the mortgagor or the borrower and should be invited to a hearing which generally takes place in a court. In the foreclosure by power of sale, the foreclosure is allowed only if a deed of trust was used.
